What is a position statement? A position statement is a short statement, usually 1 or 2 sides of A4 paper, which sets out your position for a particular court hearing. You can prepare a position statement for each court hearing you attend.
Preparing a statement for the family court can be a daunting process. Do not start your statement the night before it is due to be filed. Make sure you sleep on it several times before submitting it to the court. Don. Start off by writing a bullet point plan of what you want to tell the Judge.
You may see that the Family Court Order says you have to file and serve a statement. This means that you file (ie. post the statment to the court) the statement at court and send a copy to the other parties. You can serve the statement by posting it to the other party.

Putting your case to the court is probably the most important piece of writing you will ever do and it deserves your best shot. In this workshop you will draft your family court statement in a format that is easy to read, well crafted and full of punchy ways to make your point.
The statement must be signed, dated and contain a declaration that you believe the statement is true and recognise it may be placed before the court. On the top left-hand side of your statement, detail the court in capital letters, e.g. IN THE LONDON FAMILY COURT and the case number on the top right-hand side.
A First Hearing and Dispute Resolution Appointment (FHDRA) is the first court hearing after an application has been made to court in private family law. It is held to assist the court in identifying issues between the parties at an early stage and to see if it is possible for the parties to reach an agreement.

The second advantage to writing a position statement is that the Judge, in the majority of cases, will read it prior to the hearing and therefore will be aware of the situation and your perspective at an early stage.
A witness statement is a written document setting out the evidence of the person writing the witness statement. The evidence presented in the witness statement should include everything that a person intends to rely on in order to support their position. A witness statement differs from a position statement insofar.

Attention is drawn to rule 17.6 which sets out the consequences of verifying a statement of case containing a false statement without an honest belief in its truth, and to the procedures set out in Chapter 5 of Part 37 and in paragraphs 4.1 to 4.7 of Practice Direction 37A (Applications and proceedings in relation to contempt of court).
